Terms

By booking and/or participating in a session at Creekside Estates (“Venue”), the client (“Client”) agrees to the following terms on behalf of themselves and all participants in their party.

1. Release of Liability and Assumption of Risk

Client hereby releases, waives, discharges, and holds harmless Creekside Estates, its owners, agents, and representatives from any and all liability, claims, demands, damages, actions, causes of action, or suits of any kind or nature whatsoever, whether known or unknown, which Client now has or may hereafter have, arising out of or relating in any way to the session.

This release includes, without limitation, any claims related to bodily injury, personal injury, illness, death, or property damage that may occur during or in connection with the session.

Client acknowledges and agrees that this release is intended to be broad and inclusive to the fullest extent permitted by law.

2. Cancellation and Rescheduling

All cancellation or rescheduling requests must be submitted exclusively through the Squarespace Scheduling platform.

To be valid, cancellation or rescheduling requests must be submitted at least forty-eight (48) hours prior to the scheduled session time.

Requests made outside of Squarespace Scheduling will not be accepted.

If Client cancels, attempts to cancel improperly, or fails to appear at the scheduled date and time, Creekside Estates is not obligated to refund the deposit.

3. Venue Authority and Session Control

Creekside Estates reserves the right, at its sole discretion:

  • To prohibit the use of any equipment deemed potentially harmful to the Venue or its grounds. Attempted use of such equipment will result in immediate cancellation of the session.

  • To decline to host or continue hosting a session for any reason.

  • To dismiss Client and/or their party from the property. Client agrees to immediately comply with any such request.

  • To cancel or reschedule a session.

  • To book multiple sessions simultaneously.

4. Guest Count, Time Limits, and Penalties

Client must accurately disclose the number of guests attending the session.

Creekside Estates reserves the right to charge a penalty to the payment method on file if more guests attend than disclosed.

Sessions must conclude within the time purchased. If Client or participants utilize the Venue more than ten (10) minutes beyond the reserved and paid session time, Creekside Estates may charge a penalty to the payment method on file.

Late arrival does not extend or modify the scheduled end time.

Creekside Estates reserves the right to charge a penalty to the payment method on file in the event of theft, destruction, or damage.

If the original payment method fails, Client remains fully responsible for reconciling and satisfying all penalty charges.

5. Single Party / Single Client Rule

Client’s party must remain together as a single group. Splitting into multiple groups will be treated as multiple sessions and may result in additional charges.

Photographers are prohibited from hosting multiple clients during the same session.

If multiple clients or parties share a session, Creekside Estates reserves the right to charge a penalty to the payment method on file.

6. Damage, Theft, and Cleaning

Client agrees to fully compensate Creekside Estates for any damages, theft, destruction, or other harmful actions caused by Client or any participant in the session.

Client may be charged a cleaning fee if trash, props, or other materials are left behind following the session.

7. Restricted Areas

Client and all participants are strictly prohibited from entering or accessing any areas enclosed by doors, gates, fences, or walls.

Client and participants are not permitted to walk behind the estates.

8. Lockbox and Key Responsibility

Failure to return the access key to the lockbox by the end of the session may result in a rekeying fee of up to $1,000.

Theft of or damage to the lockbox may result in a replacement fee of up to $500.

9. Supervision of Minors

Client is solely responsible for the supervision, conduct, and safety of all children and minors participating in the session.

10. Confidentiality of Location

Client agrees not to disclose, publish, share, or distribute any information identifying the location of Creekside Estates, directly or indirectly.

Photographs containing visible address numbers displayed on an address plaque, mailbox, painted signage, or any other identifying marker may not be published in any form, including but not limited to email, advertisements, social media, or any internet platform.

Any publication, sharing, or distribution of identifying location information is strictly prohibited.

11. Acknowledgment and Binding Effect

By booking the session, Client affirms that they have read, fully understood, and agreed to these Terms and Conditions.

Client further confirms that all individuals participating in the session are bound by these Terms and that Client accepts responsibility for ensuring their compliance.
